Terms of Service

1. Who we are

Novangel is a small web design and lead-funnel studio based in the Kansas City metro. Our public marketing site exists to describe the services we offer, take inquiries from prospective clients, and provide free educational content.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to submit a form on the site or enter into any paid engagement with us.

3. The website itself

You may not:

• Scrape, mirror, or systematically harvest content from the site.
• Reverse engineer, decompile, or otherwise tamper with the site's code, styling, or assets.
• Submit forms with false, misleading, or another person's information.
• Use the site to send spam, malicious traffic, or automated abuse.
• Bypass authentication on the /admin area or any other restricted endpoint.

4. Free website reviews and other free deliverables

If we send you a free website review, audit, or similar deliverable, that document is provided "as is" for your information only. It's based on a brief look at your site and short answers from your intake form - not a comprehensive technical, accessibility, or legal audit. We don't guarantee any specific outcome from following the suggestions.

5. Paid services

Anything you pay us for - a Starter site, Growth site, Monthly Care, or custom work - is governed by a separate written agreement (a Master Services Agreement plus a Statement of Work, or the Monthly Care Agreement). These Terms apply to your use of the website and any free materials we publish. If anything in a signed agreement conflicts with these Terms for paid work, the signed agreement wins.

6. Intellectual property

All content on the site - copy, photography, logos, illustrations, the underlying source code, and the Novangel name - is owned by us or licensed to us, and is protected by copyright and trademark law. You may not copy, republish, or reuse any of it without written permission, except for the personal, non-commercial purpose of evaluating whether to hire us.

If you submit any content to us through a form (your own copy, photos, links, etc.), you keep ownership of it. You grant us a limited, non-exclusive license to view, store, and reference that content for the purpose of responding to your inquiry and, if you become a client, performing the work you hired us to do.

7. Third-party links and providers

The site links to and integrates with third-party services (Cloudflare, Supabase, Google, Calendly, etc.). We don't control those services and aren't responsible for their content, terms, or availability. Your use of any linked service is governed by that provider's own terms.

8. Disclaimers

The site is provided "as is" and "as available." To the maximum extent permitted by law:

• We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• We don't warrant that the site will be uninterrupted, error-free, secure, or free of malicious code, though we take reasonable steps to make it so.
• We don't warrant that any free advice, review, or content on the site will produce any specific business result.

9. Limitation of liability

To the maximum extent permitted by law, in no event will Novangel, its owners, employees, or contractors be liable to you for any indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, lost data, or lost business opportunity arising out of or related to your use of the site, even if we've been advised of the possibility of such damages.

Our total cumulative liability arising out of or related to the site and these Terms - for all claims combined - will not exceed one hundred US dollars ($100) if you are not a paying client. Liability for paid engagements is capped separately in the Master Services Agreement.

10. Indemnification

You agree to indemnify and hold harmless Novangelfrom any claim, loss, damage, or expense (including reasonable attorneys' fees) arising from your use of the site, any content you submit, or your violation of these Terms or any law.

11. Termination

We can suspend or terminate your access to the site at any time, with or without notice, if we reasonably believe you've violated these Terms or applicable law. Sections covering IP, disclaimers, limitation of liability, indemnification, and governing law survive any termination.

12. Changes to these Terms

We may update these Terms from time to time. The "Effective" date at the top reflects the latest version. Continued use of the site after a change means you accept the updated Terms.

13. Governing law and venue

These Terms are governed by the laws of the State referenced in our signed agreements (or, absent one, the state where Novangel is registered), without regard to conflict-of-laws rules. Any dispute arising out of or related to these Terms or your use of the site will be brought exclusively in the state or federal courts located in that state, and you consent to personal jurisdiction there.

14. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the rest stays in force. Our failure to enforce any provision isn't a waiver of our right to enforce it later. These Terms (together with the Privacy Policy and any signed agreement for paid work) are the entire agreement between you and Novangel on the subject matter they cover.
